Will & Estate Planning Checklist

I want to designate where my assets should go to after my death, rather than allowing the North Carolina Intestate Succession Act, N.C. Gen. Stat. Sec. 29-1 et. seq. to designate where my assets will go after my death.

After my death, I will be survived by my spouse and one or more of my parents, by no descendants.

After my death, I will leave a spouse and one child.

After my death, I will leave a spouse and two or more children.

After my death, I will not leave a spouse, or descendants, but will leave my parents and siblings, nieces and nephews.

I have minor children in my household and would like to designate the person to have the care and custody of my children upon the deaths of their natural guardians.

I have minor children and would like to have the ability to have the assets managed until the child or other beneficiaries reach a responsible age.

I do not want my personal representative to have to post a bond to ensure the faithful performance of his duties.

In the event one of my beneficiaries renounce their rights to receive all or part of their rights in the estate, I want to specify the manner in which the renounced interests are to pass.

I have a will but it was drafted in a jurisdiction other than the one in which I currently reside. (Under North Carolina law, your will is administered in the state and county where you resided at your death.)

The value of my taxable estate exceeds, or will exceed, $2 million dollars if I die in 2008 or $3.5 million in 2009. If I die after January 1, 2011, the value of my taxable estate will exceed $1 million dollars.

I have specific desires as to nature and extent of the life preserving measures I want to be taken if I have an incurable or irreversible condition that will result in my death within a relatively short period of time.

I have specific desires as to nature and extent of the life preserving measures I want to be taken if I become unconscious and my health care providers determine that, to a high degree of medical certainty, I will never regain my consciousness.
